Delaware Foreclosure Attorney - Job Overview Position Summary The Delaware Foreclosure Attorney represents Lenders/Servicers in Foreclosure and foreclosure related actions from file referral to deed recordation. This is a full time position based in our Georgetown or Wilmington, DE Offices and involves travel to cover related matters in the respective counties. Areas of responsibility Foreclosure * Assist in Review the Law Firm's Fair Debt letters to borrowers/mortgagors. * Review and file Foreclosure Complaint Packages Complaints / Notice of Intent to Foreclose/Affidavits of Debt/Affidavits of Notice of Intent Debt affidavits Loss Mitigation Affidavits/Lienholder's Notices. * Review Service Returns as needed. * Review and approve Judgment Packages and associated Affidavit(s). * Review and file Writs of Levari Facias. * Review and approve Notices of Sale. * Communicate with Lenders/Servicers regarding legal issues on Foreclosure related matters. * Communicate with borrowers and borrower's counsel in foreclosure/mediation actions order to resolve contested issues. * Respond to client questionnaires and surveys on Legal issues related to Delaware foreclosure. * Provide legal oversight and support to staff and paralegals for the Delaware foreclosure process. * Attend Court hearings as needed for foreclosure/eviction and litigated matters. * Attend Foreclosure Related Sales in Accomack County/Northampton County Virginia as needed. * Travel to Leesburg as needed for Delaware Team Meetings/Firm Meetings/ HR Training/ and reviewing pipeline data with management. * Ability to cover the entire state of Delaware during absences of other Delaware attorneys. Foreclosure Sales-Review Foreclosure Sales Packages and attend Sherriff's Sales in all counties on behalf of Servicers/Lenders. Litigation /Title Litigation-Resolve litigated/contested matters including but not limited to: Summary Judgment/Quite Title Actions/Title issues/ Declaratory Judgment actions/ Reformation of Mortgages/ Release of Judgments/Motions to Appoint GAL. Attorney would attend the Court hearings as necessary on these matters as well as assist outside title counsel on title related matters. Track time for both default and contested matters in case system. Deed in Lieu-Review Title and Title Related documents for Deeds in Lieu of Foreclosure. Communicate with Client and borrowers to resolve DIL issues. Mediations-Represent Lenders/Servicers at Foreclosure Mediations. Review loss mitigation documents and loan activity, address borrower/HUD Counselor's concerns, and resolve mediations in a timely manner. Communicate with Lenders' assigned representative and provide timely updates both internally and externally. Settlements-Handle Real Estate Closings related to REO matters. Evictions-Review and file Eviction matters on behalf of Lenders/Servicers in Delaware. Position Requirements * Law degree from a respected law school * Barred in Delaware, multiple states preferred * Minimum of 2-4 years of foreclosure legal experience, with hands-on practicing of cases in court. * Ethical business mindset in concert with our Company values. "We say what we mean and mean what we say." * Demonstrated administrative skills ability required (maintaining required reports, use of information technology appropriately to save time, etc.) * Must be self-starter with ability to work independently, highly-motivated, with a strong work ethic and a commitment to company values. * Superior ability to effectively and efficiently communicate both verbally and in writing at all levels. * Well networked professionally. * Tech savvy - Knowledge of technology including common software platforms used by the organization such as Microsoft Office, SoftPro, operations, title and billing solutions.
