  • Organize research data, accurately.
  • Uncover key insights.
  • Develop tables and presentations to deliver information to CFPB.
  • Create and develop remediation plan, if appropriate.
  • Create and develop new performance management systems, as necessary.
  • Draft expert reports and prepare expert opinion testimony, as necessary.

Employee will provide support to the CFPB, LD staff to review relevant documents, data, and other materials provided by LD staff.  Tasks include the following:

Performance Management

  • Perform the appropriate analyses, and/or develop reports regarding performance and compensation data

  • Review statistical analyses concerning performance ratings in order to validate existing statistical analyses

  • Develop a remediation plan to include recommendations and options for settlement support by detailed cost analyses to determine the implications of various options as well as recommendations and options for settlement.

  • Assist LD staff in preparing for an appropriate response in any forum.

  • Provide support in labor and/or management working groups,

  • Help identify attributes of a model performance management system that enhances parity and is tailored to the CFPB’s workforce.

  • Developing a compliance management system in order to provide a structured review of ratings entered for employees representing different groups prior to finalization of rating

  • Prepare reports that analyze and assess expert opinions related to ratings data that may be presented by other parties in litigation.

  • Prepare and make key personnel available to be deposed by opposing counsel and to assist the LD in preparing for any deposition of an opposing expert.

  • Prepare and make key personnel available for testimony in any forum to include arbitration. 


  • Review, analyze, and assess the quantitative factors relied on for salary determinations,

    including current salary and salary at time of hire

  • Analyze demographic characteristics of employees, including bargaining unit status, race/ethnicity, gender, age and national origin.

  • Interaction effects, as appropriate, between variables impacting results.

  • Perform detailed cost analyses to determine the implications of various options for redressing any action that may have adversely impacted group members, should the prior analyses suggest/recommend need for such action.


  • Conduct statistical analyses of current recruitment, selection (to include promotion) policies, procedures, and outreach efforts in order to determine their effectiveness at achieving a diverse workforce.

  • Experience providing organizational consulting and litigation support services in response to organizations and/or individual claimants in employment-related litigation on performance management, compensation and/or hiring

  • Experience providing direct testimony and deposition in response to organizations and/or individual claimants in employment-related litigation on performance management, compensation, and/or hiring.

  • Experience developing human capital or human resources programs with an organization subject to collective bargaining, especially for professional staff

  • Experience providing consulting and litigation support services to organizations, preferably public sector, in the areas of performance management, compensation, and/or hiring.

  • Experience providing consulting or litigation support services to federal agencies subject to Title 5 regulation and to which certain exceptions and federal personnel management flexibilities are available (e.g., experience with federal agencies under any of the following or similar programs: NSPS, excepted service, FIRREA, demonstration project).
