EMERGENCY ASSIGNMENT: Every FEMA employee has regular and recurring emergency management responsibilities, though not every position requires routine deployment to disaster sites. All positions are subject to recall around the clock for emergency management operations, which may require irregular work hours, work at locations other than the official duty station, and may include duties other than those specified in the employee's official position description. Travel requirements in support of emergency operations may be extensive in nature (weeks to months), with little advance notice, and may require employees to relocate to emergency sites with physically austere and operationally challenging conditions.

In this position, you will serve as a trial attorney under the immediate supervision of the Deputy Associate Chief Counsel of the Personnel Law Branch. Typical assignments include:
  • Supporting the Department of Justice in developing and presenting litigation in the federal courts, or state and municipal courts.
  • Independently litigating cases before the Equal Employment Opportunity Commission (EEOC), Merit Systems Protection Board (MSPB), or other administrative forums and in arbitration or alternative dispute resolution proceedings.
  • Reviewing proposals, participating in negotiations and determinations of settlement of litigation, and recommending settlement of matters in accordance with agency, DHS, or OCC directives or policies.
  • Preparing documentary evidence and witness testimony for support of dispositive motions or trial; preparing declarations and affidavits and directs investigations for the purpose of developing additional evidence in pending litigations.
  • Participating in recommendations of legislation, regulations, or changes in existing policies, practices, and agency issuances to cure or eliminate problems.
  • Reviewing disciplinary proposals and decisions for legal sufficiency.

Promotion Potential: Positions filled under Stafford Act regulations generally do not have documented promotion potential; however, dependent on an employee's ability to perform higher level duties, the continuing need for an employee to perform work associated with a higher-level position, and administrative recommendation and approval, promotions may be earned by CORE employees.

Qualifications

The qualification requirements listed below must be met within 30 days of the closing date of the announcement.

All applicants must possess the following:
  • A J.D. or LL.B. degree from an ABA accredited law school; and
  • An active membership, in good standing, of the bar of a state, territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico.

You qualify for this position at the IC-13 level (starting salary $106,823) if you possess the following: a minimum of two years of full-time professional legal experience (after Bar admission); and one full year of specialized experience equivalent to the next lower grade (IC-12) in the Federal Service. This experience may have been gained in the federal government, a state or local government, a non-profit organization, the private sector, or as a volunteer; however, your resume must clearly describe at least one year of specialized experience. Examples of specialized experience would typically include but are not limited to:
  • Preparing discovery requests and responding to discovery requests
  • Preparing evidence in preparation for trial and dispositive motions
  • Developing litigation solutions and strategies
  • Providing advice on employment laws to include Title VII, the Rehabilitation Act, and discipline.

You qualify for this position at the IC-14 level (starting salary $126,233) if you possess the following: a minimum of three years of full-time professional legal experience (after Bar admission), which includes (1) a minimum of two full years of specialized experience equivalent to the next lower grade (IC-13) in the Federal Service; (2) of the two year requirement, at least one year of specialized experience must be completing tasks of an attorney at a level of difficulty equivalent to the IC-13 level. This experience may have been gained in the federal government, a state or local government, a non-profit organization, the private sector, or as a volunteer; however, your resume must clearly describe at least one year of specialized experience. Examples of specialized experience would typically include but are not limited to:
  • Independently producing well-articulated legal opinions, memoranda, and briefs regarding complex legal issues
  • Evaluating proposed legislation and regulations and its effects on existing policies, programs and operations.
  • Advising on investigations of employee misconduct, proposed disciplinary or poor performance actions to be taken against employees
  • Advising on federal personnel policy or labor grievances

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional, philanthropic, religious, spiritual, community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.
