Duties include:
  • The Chief Counsel is the senior advisor for general law within OCDETF, and functions as the legal counsel for the component on civil, administrative, criminal, and other general law matters.
  • Provides innovative and expert legal counsel in the oversight and management of comprehensive legal activities and matters involving litigation, in accordance with applicable laws, policies, procedures, and directives
  • Serves as the senior legal advisor for general law, including employment, labor, fiscal and appropriations, procurement, ethics, information and privacy, FOIA, administrative, and other general law matters.
  • Interpretation and application of statutes, case law, regulations, and other authorities related to OCDETF's mission and program management as well as component management.
  • Advises leadership on a broad spectrum of legal issues and develops authoritative guidance for the workforce.
  • Assures that expert legal counsel and advice is provided to OCDETF leadership and officials of partner agencies.
  • Provides management oversight and direction concerning personnel, policies and programs (e.g., human resources, budget, information technology, facilities, equipment, procurement, FOIA); and ensures the efficient and effective acquisition, use, distribution and disposal of OCDETF resources in compliance with applicable policies, procedures, laws, and directives.
  • Develops policy guidance for advising on all aspects of general law representing OCDETF before administrative bodies, courts, the General Accounting Office, and with other governmental or private sector entities.
  • Reviews various legal documents for legal sufficiency, including program policies and procedures, proposed legislation, proposed revisions to regulations, and agreements affecting the interests of the Program to ensure compliance with relevant laws, regulations, and policies.
  • Confers and negotiates with senior officials in the Departments of Justice, Treasury, Homeland Security, and Defense, the Intelligence Community, and other federal, state, local, tribal, and foreign agencies on important legal and policy questions concerning the OCDETF Program.
  • Evaluates effects of pending legislation and proposed changes in existing legislation that may affect the operations of the OCDETF Program.
  • Prepares detailed legal briefs evaluating legal issues and policy ramifications for leadership.
  • Attends meetings with senior leaders and attorneys from other federal, state, local, tribal, and foreign agencies.
  • Provides authoritative technical legal guidance on complex, controversial, high value, and precedent-setting cases.
  • Personally handles complex legal matters.
  • Provides advice on extremely sensitive and confidential criminal and investigatory matters.
  • Supervises and manages a small team of lawyers and paralegals in the areas of FOIA and privacy, information sharing, and general law.
  • Oversees and conducts legal training for the OCDETF Executive Office as well as the OCDETF Fusion Center; topics will vary but may include sexual assault/harassment prevention, NO FEAR ACT, FOIA and records retention.
  • Reviews and updates all OCDETF (including OCDETF's Fusion Center and its International Organized Crime Intelligence and Operations Center) information sharing agreements to ensure compliance with changes in applicable policies and procedures, to include changes in technology that impact the collection of information and the dissemination of OCDETF products.

Qualifications

Required Qualifications : Applicants must possess a J.D. degree, be an active member of the bar in good standing in any State, territory of the United States, or the District of Columbia, and have at least 3 years post J.D. experience, one of which was specialized experience at, or equivalent to the GS-13 grade level.Examples of specialized experience include: preparing pleadings, briefs, motions, affidavits, and other materials involving legal issues in civil or criminal litigation; independently performing legal analysis; conducting civil or criminal litigation (to include appellate practitioners); trial experience as a prosecutor or defender at the Federal, State, or Local level; analyzing cases or requests for legal sufficiency; and providing expert legal advice and consultation.

Applicants must have superior academic and professional credentials as well as exceptional writing and oral communication skills. Applicants must also possess the legal skills and sound judgment necessary to evaluate the sensitive issues that arise in the course of attorney misconduct investigations. The individuals selected for these positions are required to obtain and maintain a Top Secret/SCI security clearance as a condition of employment.

Interested parties must possess a J.D., degree, be an active member of the bar (any jurisdiction) and have at least ten years of post-J.D. experience. Applicants must have solid academic credentials as well as excellent writing and strong interpersonal skills. Applicants should possess strong speaking and presentation skills; experience in the training of, and development of, professional training for prosecutors and agents. Demonstrated experience serving as a senior legal advisor for general law, including employment/labor, fiscal/appropriations/procurement, ethics, contracts, information and privacy, administrative, and other general law matters is preferred. A background in criminal prosecution including experience with long term, complex investigations; as well as electronic surveillance and related legal issues; domestic and international financial investigations; and familiarity with federal investigative agencies is desirable. Applicants must be able to secure and maintain a Top-Secret security clearance.
