NPosition Type Management Position SummaryMarriott's Law Department services the Company's lodging and hospitality business and provides legal advice and counsel to Marriott's internal clients.The Employment Practice Group ("Group"), a part of the Labor, Employment and Benefits section of the Law Department, provides legal advice and counsel regarding employment issues, policies, programs, and disputes to Human Resources professionals and on-property and corporate staff managers, and leaders within the Company's businesses.The Vice President & Senior Counsel - Employment provides both strategic and day-to-day legal advice and counsel regarding employment issues, policies, programs, and disputes to Human Resources professionals, on-property and corporate staff managers, and leaders within the Company's businesses. The individual in this position will be required to develop legal strategies, as appropriate, as well as make judgment calls and policy decisions regarding the Company's positions and provide feedback and guidance accordingly. This position is considered a senior attorney position and will be assigned complex employment issues and projects as appropriate.This position reports to the Group Leader, Vice President & Assistant General Counsel - Employment Law and may supervise an administrative position or paralegal.Specific Job Summary and Expected Contributions The primary responsibilities of this attorney will be:Taking the lead in the strategy and in the development of legally sound policies and programs in all areas of labor and employment law, including wage and hour compliance, equal employment opportunity, accommodations, and affirmative action, family and medical leave, talent acquisition, labor relations, employee data privacy, contract labor, joint employment, and acquisitions/divestitures/restructuring;Partnering withHuman Resources and business managers and providing timely, ongoing,thoughtful and through legal counsel and strategic guidance related to the management of employee issues, such as performance management, employee misconduct and workplace investigations;Evaluating and providing strategic and tactical advice to manage attorney demand letters, complaints and other employment claims, developing legally sound strategies for the Company's defense of such actions, and negotiating and drafting settlements;Directing and managing outside counsel in litigation such as wage and hour claims (to include class and collective actions) including making strategy decisions regarding depositions, discovery responses, witness preparation, and case resolution;Taking the lead in working with Risk Management on managing and assisting outside counsel in handling employment litigation covered by Employment Practices Liability Insurance;Representing the Company in dealings with administrative agencies that regulate the work environment, including EEOC, USDOL, NLRB and their state law equivalents; Partners with Human Resources to educate business partners in respective areas;Representing the Company in mediation of employment disputes;Actively monitoring trends and analyzing labor and employment laws and regulations to develop policy recommendations in partnership withHuman Resources; Provide advice and guidance on pending law changes while creating proactive strategies to ensure compliance; Performing risk assessments related to proposed initiatives, corporate activities and industry developments, recommending alternative courses of action to achieve business objectives while limiting liability and risk, Leading, managing and participating, as appropriate, in compliance audits and investigations;Maintaining in depth knowledge of Company policies, federal and state legislation, and bargaining agreements flagging issues and risks as appropriate;Educating Human Resources managers, operating business managers and others on trends and legal actions which may affect the workplace through written materials or training seminars;Partnering with attorneys in the department to address Company-wide employment issues; Participating in due diligence efforts for acquisitions and divestures as appropriate; andProviding labor and employment law support globally in both the United States and non-U.S. regions or continents, as assigned. Candidate Profile Successful candidates should possess the experience, knowledge, and skills as follows: Excellent academic records in college and law school, with a JD degree from a well-respected law school;Active Bar membership; Minimum of 10 years of substantive and applicable experience, at least some background with a high-quality law firm and/or in-house experience is preferred; Broad background in providing advice and counsel to human resources and operating business managers in complex employment and labor-related matters;Experience interfacing with government and/or labor and employment agencies which maintain jurisdiction over employment and labor-related legal matters;Experience as primary or second chair counsel in the litigation of employment and labor-related cases;Experience with cutting-edge employment and labor-related policies, programs and systems, and up-to-date knowledge of labor and employment issues and case law;Strong leadership skills and good judgment, and the ability to think strategically both from a business and legal perspective;Ability to foster relationships and individual accountability across the organization;Excellent conflict management skills, and ability to influence without coercion; Proven written and oral communication and negotiating skills;Ability to expeditiously identify and analyze issues and provide legally sound recommendations consistent with good business practices and reason;Ability to work under pressure;Strong organizational and time management skills;Ability to identify opportunities for improvement and to facilitate the implementation of creative solutions;Ability to work independently and take ownership of and effectively resolve problems; andExperience with labor and employment laws of California preferred.
