Duties

  • Schedules compliance reviews within the District Office's (DO) jurisdiction.
  • Investigates and resolves discrimination complaints, closes complaints where no basis is found and seeks appropriate resolution when applicable.
  • Negotiates and develops conciliation agreements with contractors found not to be in compliance.
  • Recommends the issuance of show cause notices when applicable.
  • Develops cases for which administrative and/or judicial actions are appropriate and recommends these actions to the Regional Director (RD) for disposition.
  • Analyzes affirmative action plans submitted by contractors, including, where appropriate, the establishment of linkage agreements.
  • Monitors contractors' conciliation agreements, progress notes, and consent decrees.
  • Conducts detailed and comprehensive analyses of federal contractors' total employment procedures and practices to determine responsiveness to federal procurement and equal employment opportunity (EEO) laws, executive orders, policies, rules and regulations.
  • Develops realistic and comprehensive approaches where there are problem areas to bring about compliance; establishes rapport with management and labor groups and tailors managerial advice to specific situations; establishes district program objectives based on a consideration and evaluation of all related factors, including community relations and local and national interests.
  • Identifies discrimination based on evaluation and investigatory activity. Assists staff in developing and presenting evidence of discrimination meeting applicable standards of proof. Identifies and defines persons and classes affected by discrimination. Ensures the staff has applied the appropriate theory of discrimination relevant to the facts, including, but not limited to, disparate treatment, adverse impact, and reasonable accommodation theories. Ensures the calculation of monetary losses and remedies designed to remedy identified violations are appropriate and accurate.
  • Serves as a subject matter expert during the development of national office courses to ensure the appropriate level of detail and complexity.
  • Identifies and resolves, as applicable, unique issues where no policy exists, recommending innovative actions to address new needs and/or issues.

Applicants must meet time-in-grade, time-after-competitive-appointment and qualifications requirements within 30 calendar days after the closing date of the vacancy to be eligible for consideration for selection.

You may not be aware, but in the regulations for agency ethics programs, there are requirements for supervisors. Section 2638.103 of Title 5 of the CFR states:

Every supervisor in the executive branch has a heightened personal responsibility for advancing government ethics. It is imperative that supervisors serve as models of ethical behavior for subordinates. Supervisors have a responsibility to help ensure that subordinates are aware of their ethical obligations under the Standards of Conduct and that subordinates know how to contact agency ethics officials. Supervisors are also responsible for working with agency ethics officials to help resolve conflicts of interests and enforce government ethics laws and regulations, including those requiring certain employees to file financial disclosure reports. In addition, supervisors are responsible, when requested, for assisting agency ethics officials in evaluating potential conflicts of interest and identifying positions subject to financial disclosure requirements.

Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level, GS-13, in the Federal Service.

  • Implements regulations and investigates programs that prohibit contractor and subcontractors from discrimination based on race, color, religion, sex (including pregnancy), sexual orientation, gender identity, national origin, disability or status as a protected veteran.

  • Ensures the appropriate theory of discrimination relevant to the facts, including, but not limited to, disparate treatment, disparate impact, and reasonable accommodation theories.

  • Plans, organizes, and conducts research on complex issues that involve major areas of uncertainty in approach, methodology, or interpretation to identify appropriate solutions.

  • Negotiates and develops conciliation agreements with contractors or personnel found not to be in compliance.
