JOB TITLE: Staff Counsel; Legal Services Department REPORT TO: General Counsel; Assistant General Counsel PURPOSE: Working with other attorneys and professionals to provide a range of legal services to the IAM National Pension Fund, the IAM National 401(k) Fund and the National IAM Benefit Trust Fund (collectively the "Funds"). This position, with other staff in the Legal Services Department, will assist the Funds in identifying legal needs, provide counsel, represent the Funds in court or regulatory proceedings and perform other duties to ensure the Funds receive the best and most cost-effective legal solutions. ESSENTIAL DUTIES AND RESPONSIBILITIES: Draft, review and negotiate legal documents including plan amendments, plan policies and procedures, contracts, confidentiality/non-disclosure agreements, reports including financial reports, performance metrics and key performance indicators, lease agreements, briefs, pleadings, appeals, and legal memoranda. Under supervision of the General Counsel, handle matters involving withdrawn employers and withdrawal liability cases. Draft, review and finalize Notice and Demands, payment arrangements, and other correspondence with withdrawn employers, assist outside counsel in negotiating payment plans when necessary, with requests for review of withdrawal liability calculations, and preparation of arbitrations and litigation. Direct paralegal work in preparing updates/input for new referrals/organize and properly close matters where appropriate, etc. Update and maintain withdrawal and withdrawal liability records. Under supervision of the General Counsel, handle matters involving delinquent employers and delinquency collection cases. Coordinate work with other relevant Funds Departments on the collection of delinquent contributions. Draft demand letters for collection of delinquent contributions. Assist outside counsel in negotiating payment plans when necessary, and preparation of litigation. Direct paralegal to timely prepare, create and provide collection status reports to General Counsel. Supervise administrative functions of the Department's collections programs on behalf of the Funds, including assisting lawyers with review and distribution of letters to delinquent employers. Draft, review and revise compliance (DOL, IRS) filings and compliance filing review. Investigate and prepare responses to agency complaints, including preparation and maintenance of subpoena and discovery responses. Perform legal and factual research. Perform records research. Identify relevant judicial decisions, statutes, legal articles, codes and other pertinent material. Organize and analyze information. Cross-check and validate information. Prepare written reports. Draft and assist in drafting legal arguments, briefs, applications, declarations and motions. Prepare correspondence. Organize and track matter and case files for which the attorney has responsibility. Stay informed of new and updated laws and regulations, particularly affecting areas of employee benefits, multiemployer retirement and welfare benefit plans. Monitor benefits and tax regulations and statutes, including ERISA and the Internal Revenue Code to ensure compliance. Coordinate Legal Services Department activities with other department employees, such as subpoena response or delivery. Other duties as assigned. EXPERIENCE Knowledge of local, state and federal laws and regulations, knowledge of laws and regulations affecting ERISA retirement and welfare benefit plans. Thorough knowledge of legal principles and practices. Thorough knowledge of legal research techniques. Thorough knowledge of legal terminology. Thorough knowledge of legal communication principles and practices. Relevant computer knowledge and experience, including experience with Microsoft Word, Excel and PowerPoint. SKILLS Experience or expertise in employee benefits law, including ERISA and the Internal Revenue Code. Strong desire to work within a team of attorneys and other professionals with high performance expectations but with the ability to work independently. Strong research, analytical and critical thinking skills. Strong verbal and written communication skills, including strong public speaking skills. Commitment to abiding by applicable laws and behaving ethically. High stress tolerance. Adaptability and attention to detail and accuracy. Confidentiality. EDUCATION Juris Doctor from an American Bar Association accredited law school. Admission to the District of Columbia bar, or the ability to become admitted within one year of hiring.
