Duties

  • The AD supervises, coordinates, and reviews the work of about 40 attorneys, investigators, and support staff who are engaged in such functions as detecting possible violations of the statutes, determining whether alleged or suspected violations warrant investigation, formulating plans and legal theories for conducting investigations, conducting actual investigations and providing assistance and guidance to the regional offices in connection with cases investigated and tried at the regional level, evaluating investigative reports for sufficiency of evidence to support formal legal action, drafting formal complaints containing charges of violation of law, and prosecuting administrative and District Court cases, including civil and criminal contempt cases.
  • Provides counsel and guidance for staff members on policy questions and matters of legal strategy and reviews the more significant legal documents prepared by the staff (e.g., proposed complaints, recommendations that cases be closed, settlement agreements, motions, proposed findings and orders) for consistency with agency policy, soundness of judgment, and legal sufficiency.
  • Participates in and leads the Division's participation in a Bureau-wide strategic planning
    process and performs all budget planning, justification and monitoring for the Division. The
    incumbent decides what funds and people are needed to effectively accomplish program goals, shifts in program emphasis, and projected completion dates; requests and monitors travel money and funds for contracts; and controls the activities of consultants and contractors performing research.
  • Guided by merit and diversity principles, interviews and hires an appropriate
    occupational mix of employees to accomplish the mission; provides meaningful and challenging assignments to develop the staff; evaluates performance and recommends awards, quality step increases and promotions; and initiates disciplinary actions when necessary.
  • Reviews final work products, stays abreast of ongoing cases through conferences and briefings with staff, provides guidance on legal strategy, and keeps the Division and Regional Office staffs informed of policy changes and status of work products.
  • Has continual contact with key Bureau officials in recommending program direction and
    influencing policy decisions and must maintain effective relationships with a variety of federal, state, and local law enforcement partners. As an expert in assigned areas, the incumbent is periodically summoned to testify before Congress and the Commission in order to discuss the Division's programs, trends in the economy, emerging problems of law violations, proposed legislation, etc.
  • Obtains the resources necessary to accomplish the program or project, ensures
    resources are used and applied in the most effective manner and consistent with resource and budget determinations, and deals with key officials from within and outside the agency to gain understanding and support for the program or project.
  • Monitors the Division's progress toward its goals and objectives and periodically evaluates and makes appropriate adjustments to its goals and objectives. Also monitors work status through formal and informal means to evaluate progress toward objectives; assesses the Division's overall effectiveness, efficiency, and productivity; identifies, diagnoses, and consults on problem areas related to achieving goals; and makes decisions on alternative courses of action.

  • You must possess a J.D. or LL.B. degree from an accredited law school.
  • Background investigation (Public Trust) is required.
  • You will serve a one-year probationary period unless you have previously completed the probationary period in the Senior Executive Service (SES).
  • The individual selected will be required to file an Executive Branch Personnel Financial Disclosure Report (OGE Form 278) in accordance with the Ethics in Government Act of 1978.
  • Due to COVID-19, the FTC is currently in a maximum telework posture through August 31, 2022. In addition, the agency is currently exploring the possibility of having a remote workforce for current and future employees beyond September 2022.
  • If selected, you will be permitted to temporarily telework from a location outside the local commuting area.
  • However, once employees are permitted to return to the office, you may be required to report to the duty station listed on this announcement within 60 days. At that time, you will be eligible to request telework in accordance with the FTC?s policy.


Qualifications

QUALIFICATIONS:
As a basic requirement, applicants must demonstrate technical and professional competence as described in the Mandatory Professional Credentials/Technical Qualifications section below and executive leadership capabilities as described in the Executive Core Qualifications (ECQs) of the SES listed below. Typically, experiences of this nature will have been gained at or above the GS-15 grade level or its equivalent in federal service, or with state or local government, private industry, or nongovernmental organizations.

If you are a current career member of the SES, are eligible for reinstatement into the SES, or have completed an SES Candidate Development Program and have been certified by the Office of Personnel Management's (OPM) Qualifications Review Board (QRB), you can apply for competitive and/or noncompetitive consideration. For competitive consideration, you must submit a resume and written statements addressing the Mandatory Professional Credentials/Technical Qualifications, ECQs, and other applicable qualifications. For noncompetitive consideration, you must submit your resume, written statements addressing the Mandatory Professional Credentials/Technical Qualifications, and other applicable qualifications. Written statements addressing the ECQs are not necessary for noncompetitive consideration. You must also provide documentation of QRB certification (i.e., SF-50 showing career SES status or OPM-issued SES qualification certificate).

MANDATORY PROFESSIONAL CREDENTIALS AND TECHNICAL QUALIFICATIONS:

Mandatory Professional Credentials :

The position requires comprehensive, professional knowledge of Federal trade regulation and consumer protection laws and regulations. Graduation from an accredited law school and current possession of a bar membership which permits the practice of law in the United States are required.

Mandatory Technical Qualifications (should not exceed two pages per qualification):

MTQ1 - Demonstrated experience in consumer protection, data security, emerging privacy issues, and privacy practices affecting consumers, and how they are applied in the agency's operations.

MTQ2 - Demonstrated experience in safeguarding consumers' privacy; investigating breaches of data security; working to prevent identity theft and aiding consumers whose identities have been stolen; and implementing laws and regulations for the credit reporting industry.

MTQ3 - Demonstrated experience in managing, leading, and supervising personnel, managing allocated financial resources, strategic planning, program evaluation, human resources management, and contract negotiations and management.

EXECUTIVE CORE QUALIFICATIONS: All applicants must submit written statements describing accomplishments that would satisfy the ECQs. You must respond to all ECQs and address each one separately, as failure to do so will result in a rating of 'ineligible' for the position. You can find additional information on the ECQs in the Guide to Senior Executive Service Qualifications. A good competency-based qualifications statement should address the following elements for each ECQ: (a) the goal, problem, or activity and its challenge, (b) the context or environment in which the activity took place, (c) specific actions you took to address the challenge, and (d) the results or impact of the activity. Each accomplishment should be clear, concise, and emphasize your level of responsibilities, the scope and complexity of the programs you managed, and the results of your actions. You are strongly encouraged to review the Guide to Senior Executive Service Qualifications. The ECQ statement, addressing all five ECQs, may be no longer than ten pages.

ECQ 1 - Leading Change: This ECQ involves the ability to bring about strategic change, both within and outside the organization, to meet organizational goals. Inherent to this ECQ is the ability to establish an organizational vision and to implement it in a continuously changing environment.

ECQ 2 - Leading People: This ECQ involves the ability to lead people toward meeting the organization's vision, mission, and goals. Inherent to this ECQ is the ability to provide an inclusive workplace that fosters the development of others, facilitates cooperation and teamwork, and supports the constructive resolution of conflicts.

ECQ 3 - Results Driven: This ECQ involves the ability to meet organizational goals and customer expectations. Inherent to this ECQ is the ability to make decisions that produce high-quality results by applying technical knowledge, analyzing problems, and calculating risks.

ECQ 4 - Business Acumen : This ECQ involves the ability to manage human, financial, and information resources strategically.

ECQ 5 - Building Coalitions: This ECQ involves the ability to build coalitions internally and with other federal agencies, state and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals.

Education

Graduation from an accredited law school and current possession of a bar membership, which permits the practice of law in the United States, are required. Total background, including experience, education, awards, self-development, and training will be reviewed.

Additional information

1. The agency may reimburse relocation expenses.
2. If we select you for an initial career appointment to an SES position, the OPM QRB must approve your ECQs prior to appointment. A selection is tentative until we obtain a QRB certification.
