Duties

The Director of the Executive Office for U.S. Trustees (EOUST) provides executive leadership and central policy and management direction to the EOUST, the U.S. Trustees, and their staffs. Additionally, the Director carries out the mission of the U.S. Trustee Program (USTP or Program) to promote the integrity and efficiency of the bankruptcy system for the benefit of all stakeholders-debtors, creditors, and the public.

The Program is headquartered in Washington, DC, and has 21 regions managed by U.S. Trustees with 90 field offices supervised by Assistant U.S. Trustees and a staff of approximately 1,000 employees, consisting primarily of attorneys, financial analysts, paralegals, and administrative, information technology, and other support staff. In addition, the USTP appoints and oversees about 1,200 private trustees (not government employees) who administer bankruptcy cases under chapters 7, 12, and 13 of the Bankruptcy Code; maintains pools of about 250 individuals who are appointed on a case-by-case basis as chapter 11 subchapter V trustees; and approves and monitors more than 200 credit counseling agencies and debtor education providers that offer statutorily required services to individual debtors.

Primary Responsibilities:

-Provides executive leadership and central policy and management direction to the USTP to establish and execute the Program's organizational vision, culture, and goals and ensure the proper administration, monitoring, and oversight of all federal bankruptcy cases. Monitors operations and oversees the Program's litigation activities to ensure that employees and business practices are consistent and comply with the Program's legal positions and regulatory and legal requirements. Ensures criminal violations are referred to law enforcement partners.

-Exercises full managerial authority over the USTP, including: directing activities, framing strategic plans based on broad organizational assessments and evaluation of long-term organizational objectives; overseeing and determining the financial and personnel resources needed to achieve mission objectives and support mission operations; identifying the need for major organizational improvements, developing the requisite plans, and direct implementing actions; and overseeing and directing the internal organization, staffing, policies, and personnel authorities required to carry out the responsibilities of the Program.

-Serves as a consultant within the Department of Justice (DOJ) on all matters concerning bankruptcy. Collaborates with top DOJ officials and maintains liaison and builds coalitions with other DOJ components, the judiciary, federal and state agencies, Congress, national trustee organizations, bankruptcy-related professional organizations, and international insolvency organizations on legal matters which involve or impact bankruptcy law. Regularly consults with the U.S. Trustees on legal strategies on cases of importance to the Program and to ensure a common understanding of legal issues.

-Maintains direct involvement in the oversight of difficult and precedent-setting cases or cases of unusual complexity or sensitivity. Determines the Program's strategies in such cases and ensures pleadings, motions, interrogatories, findings of fact, other documentation, as well as presentations in court or in settlement negotiations, are of the highest caliber.

-Seeks to secure correct, uniform, and fair interpretations of bankruptcy and related laws in federal district and appellate courts, and to ensure that uniform standards are applied in prosecutions. Assists the Office of the Solicitor General on appeals to the Supreme Court as needed.

-Analyzes and reviews proposed legislation that may affect the Program or is related to the work of the USTP and assists in formulating DOJ's position by commenting on or making recommendations to revise, support, or oppose such legislation. Testifies before Congressional committees on legislation or inquiries regarding the work of the USTP as required.

-Oversees the development and execution of the Program's budget, managing financial and personnel resources to ensure appropriate deployment of assets to meet mission.

-Attends and speaks at national conferences and consortiums on bankruptcy law matters and issues that are of current important to the Program and the DOJ.

  • You must be a United States Citizen or National.
  • Veterans' preference is not applicable to the Senior Executive Service.
  • Selective Service registration is required for males born on, or after, December 31st, 1959. Those not registered should have an approved exemption on file.
  • You will be required to complete a pre-employment security investigation and background check for the security level designated for this position.
  • You will be required to undergo a drug screening and obtain favorable results prior to being appointed.
  • You may be subject to a one-year probationary period effective from the date in which you are appointed.
  • This position requires you to submit a Public Financial Disclosure Report (OGE 278) upon entry, and annually thereafter in accordance with DOJ and Federal ethics guidelines.
  • You must meet all minimum qualifications to be deemed eligible. Only experience obtained by closing date of this announcement will be considered.
  • As a basic requirement for entry into the SES, applicants must provide evidence of progressively responsible leadership experience that is indicative of senior executive level management capability and directly related to the skills and abilities outlined under the Mandatory Technical Qualifications and Executive Core Qualifications.

    Qualifications

    MTQ1: Extensive knowledge of bankruptcy law and rules with a proven ability to successfully develop, convey, and implement positions, policies, and practices across a highly decentralized environment.

    MTQ2: Demonstrated ability to communicate and collaborate with diverse members of the legal and governmental community, including the bench, bar associations, members of Congress and congressional staff, the media, academics, trustee organizations, professional organizations, and other stakeholders in the bankruptcy system.

    MTQ3: Demonstrated knowledge of law and regulations applicable to the administration of a large federal agency, including but not limited to, appropriations and financial management, government procurement, federal employment, Equal Employment Opportunity, appointment of inferior officers, personnel and physical security, Freedom of Information and Privacy Acts, management and security of information technology systems, and administrative law (e.g., Administrative Procedure Act and Paperwork Reduction Act, applicable OMB Circulars, and related mandatory guidance.)

    MTQ4: Executive level experience in government/business policy and program analysis that contributes to effective executive-level strategic planning, policy development, and execution of major new programs and initiatives impacting both consumer and business bankruptcy cases and enforcement activities

    Education

    Applicants must possess a J.D. degree from a law school accredited by the American Bar Association, have at least 10 years of relevant post-J.D. experience, and be an active member of the bar in good standing of a state, U.S. Territory, the District of Columbia, or the Commonwealth of Puerto Rico.
