Duties

This position is located Defense Legal Services Agency (DLSA) with duties performed in the Missile Defense Agency (MDA) Office of General Counsel (OGC). The General Counsel (GC) of the Department of Defense (DOD) serves as the chief legal officer of DOD. The DOD GC is also dual-hatted as the Director of DLSA, which provides a full range of legal services to the Office of the Secretary of Defense, the Defense Agencies, and DOD Field Activities. The MDA OGC GC reports to the DOD GC through the Principal Deputy General Counsel, Senior Deputy General Counsel, and Deputy General Counsel (Acquisition & Logistics)

The General Counsel, MDA is head of the Office of General Counsel MDA and performs the following major duties:
  • Oversees his office, exercises professional direction over attorneys assigned to MDA, is the principal legal advisor to the Director, MDA, who serves as Senior Procurement Executive, Head of the Contracting Agency, and Program Manager MDA programs. The General Counsel, MDA has ultimate responsibility for the development and management of an organizational structure to achieve the effective delivery of legal services to MDA. The General Counsel establishes and maintains professional relationships with legal organizations in the Military Departments and other government agencies participating in the BMD program. The General Counsel reports to the DoD Deputy General Counsel (Acquisition & Logistics).
  • Directs a staff of 22 attorneys in providing all legal support and representation necessary to execute a single program to defend the United States, deployed forces, allies, and friends from missile attacks of all ranges in all phases of flight.
  • Serves as the principal legal advisor to the Director, MDA Executive Director, Program Executives, Executive Functional Managers, and staff organizations across the agency, and provides legal advice, counsel, and representation on the full range of MDA activities.
  • In executing the agency's mission and assigned responsibilities, MDA regularly enters agreements with other DoD components and government agencies. The General Counsel, MDA consults regularly with the General Counsel and executives of DoD components and other government agencies regarding the full range of legal issues including, but not limited to, U.S. treaty and other international obligations, and fiscal, acquisition, personnel, and environmental law.
  • Provides the full range of legal advice and services to MDA in connection with contracts placed by the Agency. Such legal advice and services includes review of legal documents such as contracts, drafting, or supervising the drafting of special contract clauses, advice and assistance in the negotiation of contracts in cases involving issues of legal or significant policy content; resolution of protests against contract awards; settlement of claims or disputes under contracts; and settlement or other disposition of notices and claims relating to the termination of contracts. As necessary during pre- and post-award contracting stages, the incumbent provides advice and information to the legal staffs of government organizations contracting for MDA requirements.
  • Participates in Department of Defense and MDA negotiations conducted with allied and friendly governments to establish policies and procedures for participation in MDA programs. Incumbent advises U.S. negotiators and, as appropriate, presents the U.S. Government position to foreign government representatives. Incumbent is responsible for providing a full range of legal advice and services relating to international cooperative efforts, including research, development, testing, data exchange, co-production, foreign military sales, and export controls. Incumbent is responsible for legal oversight of staffing, negotiating, and concluding international agreements for MDA activities.
  • The incumbent reviews Military Interdepartmental Purchase Requests (MIPRs) and other documents transferring MDA funds under the Economy Act for work to be performed, including award of contracts, to meet MDA requirements by the Military Departments, Defense Agencies, Department of Energy, NASA, and other government agencies. The incumbent participates in development of policies and procedures necessary to implement inter-governmental MDA research agreements.
  • The incumbent supervises the Agency's adversary proceedings program providing direct representation in administrative for a such as the Armed Services Board of Contract Appeals, The Comptroller General of the United States on bid protests, the Merit Systems Protection Board, and the Equal Employment Opportunity Commission.

ECQ 4 - BUSINESS ACUMEN: This core qualification involves the ability to manage human, financial, and information resources strategically. Do not exceed a total of 10 pages for ECQ narratives.

ECQ 5 - BUILDING COALITIONS: This core qualification involves the ability to build coalitions internally and with other federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals. Do not exceed a total of 10 pages for ECQ narratives.

TECHNICAL QUALIFICATIONS: All applicants must submit written statements (narrative format) of accomplishments that would satisfy the technical qualifications. You must address each technical qualification separately.
  • The incumbent should be knowledgeable of statutes governing the organization of the DoD, particularly those provisions underlying authorities expressly granted or delegable to Heads of the Defense Agencies.
  • The incumbent should be knowledgeable of basic principles and procedures governing litigation in administrative and judicial forums, particularly litigation of contract-related protests and disputes and employment law (e.g., MSPB, EEO, etc.).
  • The incumbent should be knowledgeable of basic principles of fiscal law and rules of statutory interpretation as they are applied to annual funding authorization and appropriation statutes, procurement. Knowledge of environmental law, personnel law, and FOIA are a plus.
  • Failure to meet any one of the technical qualifications requirements automatically disqualifies an applicant.

    Education

    You must have a first professional law degree (LL.B. or J.D.). You must have a current license to practice law and be an active member in the bar of at least one state, the District of Columbia, or a U.S. commonwealth or U.S. territory, and be able to demonstrate that in a least one state or jurisdiction in which you are licensed you are permitted to engage in the active practice of law. Active status must be maintained in at least one state or jurisdiction during the course of employment.

    SELECTIVE SERVICE REQUIREMENT: If you are a male born after December 31, 1959, and are at least 18 years of age, civil service employment (5 U.S.C. 3328) requires that you must be registered with the Selective Service System, unless you meet certain exemptions under Selective Service law.     Background Investigation: This position is designated special sensitive as defined in DoD 5200.2-R and therefore requires that a personnel security investigation be adjudicated for security eligibility on a pre-appointment basis. This requirement may take 120 days or longer to process. The incumbent must complete a Single Scope Background Investigation (SSBI) and favorable adjudication by a determining authority and be eligible for a Top Secret clearance and access to sensitive compartmented information (SCI).
